These terms and conditions govern your purchase of products from PavingUK. Please read them carefully before placing your order. By placing an order, you agree to be bound by these terms.

1. DEFINITIONS

In these Terms & Conditions:

  • “We”, “Us”, “Our”: Milton Garden Products Limited trading as PavingUK
  • “You”, “Your”: The person or business placing the order
  • “Goods”: The products you order from us
  • “Order”: Your request to purchase goods from us
  • “Contract”: The legally binding agreement between you and us

2. HOW THE CONTRACT IS FORMED

2.1 Placing Your Order

When you place an order (online or by phone), you are making an offer to purchase goods subject to these Terms & Conditions.

2.2 Order Acceptance

We will confirm acceptance of your order by email. The contract is formed when we send this confirmation email.

2.3 We May Refuse Orders

We reserve the right to refuse any order before acceptance, particularly if:

  • Goods are unavailable
  • Pricing errors have occurred
  • We cannot deliver to your address
  • Payment cannot be verified

3. PAYMENT TERMS

3.1 Payment in Full Before Dispatch

Payment must be made in full at the time of order, before goods are dispatched.

3.2 Payment Methods

We accept:

  • Credit and debit cards (via website checkout or payment link)
  • Bank transfer (BACS)

3.3 Pricing and VAT

  • All prices include VAT unless stated otherwise
  • Prices are subject to change without notice
  • The price charged is the price shown at time of order acceptance
  • Delivery charges shown separately where applicable

4. DELIVERY

4.1 Delivery Area

We deliver nationwide across the UK. Delivery charges vary by location and are confirmed at time of order.

4.2 Delivery Times

Delivery times are estimates only and not guaranteed. We will make reasonable efforts to deliver within the timeframe quoted.

4.3 Delivery Charges

Delivery charges are calculated based on:

  • Delivery location and distance
  • Weight and volume of goods
  • Type of delivery service selected

All delivery charges are confirmed before you complete your order.

4.4 Failed Deliveries

If delivery cannot be completed due to:

  • No one available to accept delivery
  • Incorrect or incomplete delivery details provided by you
  • Unsafe or inaccessible delivery location
  • You refusing delivery (except for damaged goods – see our Returns Policy)

You will be charged a re-delivery fee of £50 per delivery attempt.

4.5 Risk and Responsibility

  • Risk passes to you: When goods are delivered to your address
  • Your responsibility: To inspect goods on delivery
  • Damaged goods on arrival: See our Returns & Refunds Policy for what to do
  • Storage: You must store goods appropriately after delivery – we are not liable for damage caused by poor storage

4.6 Delivery Address Changes

Once your order has been placed, the delivery address cannot be changed. This is standard industry practice to protect against fraud.

If you have entered an incorrect delivery address, you must:

  • Cancel your existing order (subject to our Returns & Refunds Policy)
  • Place a new order with the correct delivery address
  • Refund will be processed within 14 days

Please check your delivery address carefully before placing your order.

5. PRODUCT INFORMATION

5.1 Descriptions and Measurements

We take care to ensure product descriptions and measurements are accurate. However:

  • All measurements are approximate and may vary slightly
  • Product images are for illustration purposes – actual products may vary
  • Colours displayed on screen may differ from actual products

5.2 Natural Materials

Natural stone and porcelain products vary in colour, texture, and appearance. For full details on natural variation and batch differences, please see our Returns & Refunds Policy.

5.3 Pricing Errors

We reserve the right to cancel orders where pricing is clearly incorrect due to technical or human error. You will receive a full refund if this occurs.

5.4 Stock Availability

All products are subject to availability. If ordered items are unavailable, we will contact you to offer:

  • A suitable alternative product
  • A full refund
  • Delay until stock becomes available (with your agreement)

6. SPECIAL ORDERS

7. TITLE AND OWNERSHIP

7.1 Retention of Title

Goods remain our property until you have paid for them in full. Until payment is received, you hold the goods as bailee only.

7.2 Right to Repossess

Until payment is received in full, we reserve the right to repossess goods. You must allow us reasonable access to recover our property.

  • We can repossess: Unused goods in original condition
  • We cannot repossess: Goods that have been installed, altered, incorporated into other works, or commingled with other materials

7.3 Installed Goods

Title passes to you immediately if goods are installed, incorporated into other products, or otherwise altered from their original state, even if payment has not been received. You remain liable for the full purchase price.

7.4 Goods Sold to Third Parties

If you sell goods to a third party before paying us in full, you must:

  • Hold the proceeds in trust for us
  • Keep those proceeds separate from your other funds
  • Pay us immediately upon receipt of payment from the third party

8. LIABILITY AND WARRANTIES

8.1 Faulty Goods

8.2 What We Are NOT Liable For

We are NOT liable for:

  • Loss of profits or business
  • Loss of contracts or opportunities
  • Consequential or indirect losses
  • Damage caused by improper installation
  • Damage caused by failure to follow manufacturer’s instructions
  • Normal wear and tear
  • Natural variation in stone or porcelain products
  • Colour differences from screen images or samples

8.3 Limitation of Liability

Where we are liable, our total liability is limited to the price paid for the goods in question.

8.4 Nothing in These Terms Affects

  • Your statutory rights under the Consumer Rights Act 2015
  • Our liability for death or personal injury caused by our negligence
  • Our liability for fraud or fraudulent misrepresentation

9. FORCE MAJEURE

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:

  • Acts of God, natural disasters, severe weather
  • War, terrorism, civil unrest
  • Government restrictions or regulations
  • Fire, flood, explosion
  • Strikes, industrial action
  • Failure of suppliers or subcontractors
  • Transport delays or accidents
  • Telecommunications failures

If such events occur, we may:

  • Suspend performance until the event resolves
  • Cancel the contract with full refund
  • Offer alternative arrangements

10. GENERAL PROVISIONS

10.1 Entire Agreement

These Terms & Conditions, together with our Returns & Refunds Policy, constitute the entire agreement between you and us.

10.2 Variation

We may update these Terms & Conditions from time to time. Changes will be posted on our website and apply to orders placed after the date of posting.

10.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10.4 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

10.5 Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another organization.

10.6 Third Party Rights

These Terms are between you and us. No other person has any rights to enforce any of these Terms.

10.7 Data Protection

We process your personal data in accordance with UK data protection law. We use your information solely for fulfilling your order, including providing details to delivery couriers. We will not use your details for any other purpose without your consent.

10.8 Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
